Hydrogen and Fuel Cell Association of Singapore (HFCAS)
Each Member agrees to abide by these terms and conditions of the HFCAS membership (“T&Cs”), as set forth below. HFCAS may change the T&Cs at any time with or without notice, and each Member’s continued participation in HFCAS shall be considered acceptance of such changes. Failure to comply with the T&Cs may result in the suspension or expulsion of the Member (in accordance with Article 7.6 of the HFCAS Constitution).
These T&Cs are subject to the HFCAS Constitution and override any contrary terms or conditions published by us in relation to any membership subscription between you and us.
Definitions and interpretation
1.1. The following terms have the references set out below:
“HFCAS Membership” refers to a Member’s membership with HFCAS.
“Corporate Entity” refers to any corporate, organisation or entity.
“Corporate Entity Member” refers to any Corporate Entity that is a Member.
“Individual Member” refers to any individual that is a Member.
“Member” means a member of HFCAS.
“Membership Term” means one (1) year commencing on 1 April and ending on 31 March of the following calendar year.
“Membership Fee” means the fee payable for a HFCAS Membership as set out in Clause 2.1.
“PDPA” means the Personal Data Protection Act 2012.
“You” and “your” means and refers to the Individual Member or Corporate Entity Member.
“We”, “our” or “HFCAS” refers to the Hydrogen and Fuel Cell Association of Singapore.
Membership Benefits
2.1 Membership Fees and packages vary according to the categories of HFCAS Membership. Details of our current membership packages and the respective Membership Fees can be found here.
2.2 We reserve the right to change the benefits that apply to your HFCAS Membership at any time and without prior notice.
2.3 Each Corporate Entity requires their own subscription and membership benefits cannot be shared across Corporate Entities who are not members of the HFCAS.
2.4 Each Corporate Entity Member is responsible for updating HFCAS with any changes to the contact details of their representative(s) to ensure that they can receive the full benefit of their HFCAS Membership. You can update your representative’s details by contacting membership@hfcas.org .
2.5 The number of people that can access benefits varies according to the categories of HFCAS Membership held. Details of the categories of HFCAS Memberships can be found here.
2.6 The number of free places at available at HFCAS events is determined by the category of HFCAS Membership held by a Member. HFCAS cannot guarantee places to Members at every event and reserves the right to cancel a reservation and to cancel an event. HFCAS will not be responsible for any losses, damages, costs and expenses incurred by each Members arising out of cancellation.
2.8 Places at events are only available for Members and are non-transferable.
2.9 Members may be charged a fee as indicated in the event invitation (or as notified by HFCAS) if they wish to attend the HFCAS’s events.
Membership Contract
3.1 Unless otherwise determined by HFCAS, Membership Fees are payable in full by each prospective Member for the Membership Term, regardless of the date on which such prospective Member’s HFCAS Membership commences. For the avoidance of doubt, if an Individual or a Corporate Entity joins as a Member midway through the current Membership Term, the full Membership Fee for the applicable category of HFCAS Membership shall be payable without any pro-rating. Membership Fees for the subsequent Membership Term may be subject to change by HFCAS upon the expiration of the existing Membership Term.
3.2 When submitting an online application for membership, you will be required to accept these T&Cs. Our acceptance of your application and receipt of your membership fee will create a legally binding contract between you and HFCAS incorporating these T&Cs.
3.3 Once your application has been approved, you will be liable to pay the Membership Fee through one of the available payment methods.
3.4 Your HFCAS Membership will commence for the current Membership Term once payment has been received and verified.
3.5 Membership details will be provided by electronic means within 10 working days after a receipt for your Membership Fee is issued by HFCAS.
3.6 Your membership will be due for renewal at the end of the Membership Term and a renewal notice with an invoice for the Membership Fee will be issued one calendar month prior to the end of the Membership Term.
3.7 Non-payment of invoice will result in the lapse of your HFCAS Membership after 30 calendar days of invoice date.
Cancellation and Refund
4.1 Cancellation of membership can be made in writing to membership@hfcas.org at least one (1) month before the effective date of cancellation of membership.
4.2 We will assume that you do not wish to renew your membership if payment of your membership fee is not received by the invoice due date per Paragraph 3.7.
4.3 Membership Fees are not refundable on cancellation.
Publications, Resources and Website
5.1 All tools, materials and information available on the HFCAS website as part of its membership offer are for your private use only and must not be used directly or indirectly for commercial purposes of any kind without our prior written consent.
5.2 All HFCAS publications provided to you as part of the privileges of your HFCAS Membership are for your private use only and must not be used directly or indirectly for commercial purposes of any kind without our prior written consent.
5.3 By becoming a Member of the HFCAS, you agree to not pass on to third parties or publish any HFCAS guidance and information without seeking advance written permission from the HFCAS.
5.4 Unless otherwise stated we own the copyright and any other intellectual property rights in all material on the HFCAS website and in our publications (or are licensed to use the same). Materials include, but are not limited to, the design, layout, look, appearance, graphics and documents on this website, as well as other content such as articles and other text.
5.5 Whilst we try to ensure that the information on the HFCAS website, and associated publications is current and correct no undertaking, representation, warranty or other assurance, express or implied, is made or given by or on behalf of the HFCAS as to the reliability, accuracy or completeness of the information, opinions, advertising, data or other materials contained on the HFCAS website or our publication materials. No responsibility or liability is accepted by HFCAS for any such information, opinions, advertising, or data.
5.6 Where the HFCAS website or publication materials contains links to other sites and resources provided by third parties, these links are provided for your information only, we have no control over the contents of those sites or resources.
5.7 Written requests to use the information available on the HFCAS website or our publication materials for commercial purposes may be submitted via email to membership@hfcas.org and should not be used until written agreement from the HFCAS is obtained.
5.8 Certain publication and content disseminated by HFCAS may be marked “Confidential” or “Proprietary.” In that event, you agree to maintain the confidentiality of such content and not to disclose or make it available to any third parties.
Data Protection
6.1 We generally do not collect your personal data (as defined under the PDPA) unless (a) it is provided to us voluntarily by you directly or via a third party who has been duly authorised by you to disclose your personal data to us (your “authorised representative”) after (i) you (or your authorised representative) have been notified of the purposes for which the data is collected, and (ii) you (or your authorised representative) have provided written consent to the collection and usage of your personal data for those purposes, or (b) collection and use of personal data without consent is permitted or required by the PDPA or other laws. We shall seek your consent before collecting any additional personal data and before using your personal data for a purpose which has not been notified to you (except where permitted or authorised by law).
6.2 We may collect and use your personal data for any or all of the following purposes:
(a) performing obligations in the course of or in connection with your HFCAS Membership;
(b) verifying your identity;
(c) responding to, handling, and processing queries, requests, applications, complaints, and feedback from you;
(d) managing your relationship with us;
(e) complying with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;
(f) any other purposes for which you have provided the information;
(g) transmitting to any unaffiliated third parties including our third party service providers and agents, and relevant governmental and/or regulatory authorities, whether in Singapore or abroad, for the aforementioned purposes;
(h) any other incidental business purposes related to or in connection with the above; and
(i) organising events such as seminars and networking sessions.
6.3 We may disclose your personal data:
(a) where such disclosure is required for performing obligations in the course of or in connection with our provision of the goods and services requested by you; or
(b) to third party service providers, agents and other organisations we have engaged to perform any of the functions with reference to the above-mentioned purposes.
6.4 The purposes listed in the above clauses may continue to apply even in situations where your relationship with us has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under a contract with you).
6.5 If have any enquiries about your personal data or if you wish to make (a) an access request for a copy of the personal data which we hold about you, or (b) a correction request to correct or update any of your personal data which we hold about you, you may submit your request in writing or via email to our Data Protection Officer at the contact details provided below.
6.6 Please note that a reasonable fee may be charged as permitted by law for an access request. If so, we will inform you of the fee before processing your request.

General
7.1 These T&Cs and any non-contractual obligations arising out of or in connection with these T&Cs shall be governed by, and construed in accordance with, Singapore law.
7.2 In the event that any of these T&Cs are held to be invalid, the remainder of the T&Cs shall remain in full force and effect.
